2017 PET SALES CONTRACT

 

This contract is between Norma Turk(breeder) hereinafter referred to as SELLER and

__________________________________________________________hereinafter referred to as BUYER(s)).

This agreement is made and entered on __________________________________(date) between both the SELLER AND BUYER for the purpose of setting forth the terms and conditions of the purchase by the BUYER of a purebred Labrador Retriever from the litter stated below.

Buyer has freely agreed to purchase the Labrador Retriever described above for the sum of $___________. The BUYER accepts the responsibility of purchasing the above said dog/puppy as "AS IS WITH NO WARRANTIES " except where offered warranties are otherwise stated. This contract is ONLY for one (1) year after purchase.. This contract is not transferable.

A non-refundable deposit of $500 is required to reserve a puppy. If the puppy is NOT available (due to health, gender, color) 100% of the deposit will be refunded. If the BUYER changes his mind after the SELLER receives deposit, it will be retained for care and advertising until a suitable placement can be arranged. SELLER has the option to terminate sale and return 100% of deposit fee prior to sale.
Purchase price does not include the cost of shipping, crate and bill of health. These costs will the responsibility of the BUYER.

HEALTH: SELLER guarantees that to the best of her knowledge, the puppy is in good health at the time of sale. The BUYER agrees to take the puppy to a licensed veterinarian within 48 hours of purchase for evaluation. If said puppy is found to be unhealthy by a licensed veterinarian, then the BUYER may return the puppy and all relating paperwork within a 48 hour period and will receive a full refund. SELLER will require a letter from the veterinarian stating the nature of the health problem. If said puppy has to be shipped back, these costs will be the responsibility of the BUYER.

TEMPERAMENT: Temperament is the most important characteristic of the Labrador Retriever. At the time of sale, all puppies have been evaluated as having a sound temperament. If the BUYER believes that the dog has developed a temperament problem, the dog must be returned to the SELLER, or a third party authorized by the SELLER, at the BUYERS expense, for evaluation. If the SELLER determines the dog has a temperament/behavioral problem, the BUYER will be provided a replacement puppy. IF THE SELLER DETERMINES THAT THE DOG RETURNED FOR TEMPERMENT PROBLEMS HAS BEEN ABUSED OR NEGLECTED IN ANY WAY (INCLUDING A LACK OF/OR IMPROPER SOCIALIZATION OR LACK OF BASIC OBEDIENCE COMMANDS) NO REPLACEMENT PUPPY and NO CASH REFUND WILL BE PROVIDED. Furthermore, the BUYER agrees to surrender the dog and sign the necessary papers to transfer sole ownership of the dog to the SELLER without any right of refund or any other monetary consideration. If said puppy has not attended obedience school as well as puppy kindergarten, this contract is null and void regarding temperament. It is important that the puppy learns who is the boss and how to socialize with other puppies/dogs as well as people.

DYSPLASIA: Studies have shown that early neutoring and spaying increases the chances for hip dysplasia as growth plates do not close until dogs are two years old. SELLER recommends that pups should not be neutored or spayed before the age of two years old.: SELLER offers no explicit guarantees against hip or elbow dysplasia. However, if said dog becomes disabled by hip or elbow dysplasia before the age of 12 months old due to a genetic defect in the hip or elbow and has to be euthanized, SELLER will replace the dog with one of equal value. There are NO cash refunds. SELLER requires BUYER to submit xrays to the ORTHOPEDIC FOUNDATION FOR ANIMALS.
REQUIREMENTS:
1. Buyer should educate himself/herself to proper nutrition of the dog so as not to induce joint problems of either lack of nutrition or by causing an overweight condition in a developing dog/puppy.
2. OFA'S refusal must be sent to SELLER.
3. SELLER will not replace a MILDLY DYSPLASTIC DOG.
4 Vet's letter of euthanization of said dog.
5. All shipping costs on the replacement puppy are those of the BUYER.
6. The final decision to replace a puppy and the timing of such a replacement is at the discretion of the SELLER.

7. BUYER'S pet must not be neutored or spayed.

If BUYER decides to keep puppy, SELLER will refund 50% of purchase price. SELLER has 6 months to refund 50% purchase price. (said dog/puppy must not be older than one (1) year old when diagnosis is made)

BUYER agrees to provide a life-long commitment, comfortable environment, prompt medical attention, and responsible care. This includes keeping this puppy/dog parasite free and up to date with inoculations, proper nutrition, which consists of a good quality dog food at regular intervals, and fresh water available at all times. The BUYER promises to provide a safe environment for the dog and never allow the dog to roam freely without proper fencing or supervision.

Above described dog is being sold as a "pet quality" companion dog under AKC limited registration. SELLER will require that BUYER use the kennel name "PALOMA" as its prefix when registering with the AKC. Said dog/puppy shall at no time be forfeited to a dog pound or similar rescue organization, or otherwise abandoned in any other fashion.

BUYER agrees to release and hold harmless the SELLER for any and all liability, damages or injuries caused either directly or indirectly by said dog/puppy to any person, whether actual or legal, or to any property, whether real or personal. Furthermore, BUYER assumes full liablility for any damages or injuries whether physical, mental, emotional, or economic, cause by said dog/puppy to any person, whether real or personal, after receiving and acknowledging delivery an possession of said dog/puppy.

The BUYER agrees that if, for an reason, he/she is unable to keep the dog at anytime during the dog's life, the dog will be returned to the SELLER who will relocate the dog to a suitable home. THIS IS AGREED TO BY THE BUYER AS A CONDITION OF THE SALE OF THE PUPPY/DOG. Furthermore, the BUYER agrees to sign the necessary papers to transfer the sole ownership of the dog back to the SELLER. This includes, but is not limited to, the AMERICAN KENNEL CLUB registration. There will be NO REPLACEMENT PUPPY OR ANY CASH REFUNDS.

** The undersigned (Buyer) agrees to uphold all covenants of the Agreement to insure the well being and protection of the puppy/dog. If Buyer breaches any part of this Agreement, Seller/Breeder is released from any obligation under this Agreement. Buyer agrees that he/she understand this Agreement fully.**
